Terms and Conditions:

Use of this site is subject to the following Terms and Conditions, which set the rules of how we run this site and we encourage all users to read. By using this site, you are acknowledging that you have read and agree to abide and comply with the Terms and Conditions.

We reserve the right to change the content of this website, including these Terms and Conditions at any time without notice on the website. We encourage all users of this website to familiarize yourself with the Terms and Conditions regularly to ensure they are well aware of the changes. The use of the website after any change is posted will signify that the user accepts the modification of the Terms and Conditions. If you do not accept these Terms and Conditions, please do not use this website.

 

Shopping on the Website:

The following Terms and Conditions apply to how we supply any article exposed for sale on this website and that you have purchased on this website. Nothing in these Terms and Conditions affects your rights as a consumer. The information, services and items displayed for sale on this web site are intended for use by residents of Puerto Rico only, and are not intended for residents of other jurisdictions.

 

Your State:

By placing an order through our site, you warrant that:

(I) are legally capable of entering into binding contracts on its own behalf or on behalf of the school to which you are acting (if any); and

(Ii) has at least 18 years of age.

 

How the contract between you and us is formed:

After establishing your order you will receive an email from us acknowledging that we have received your order. Please note that this does not mean that your order has been accepted. Your order constitutes an offer to us to purchase items that are exposed on the website for sale. All orders are subject to acceptance and we will confirm such acceptance via email confirming that the items have been shipped. The contract between you and us will be formed when we have sent the confirmation of dispatch.

 

Prices:

The prices shown on the website exclude IVU. The IVU  is added at time of payment. The products displayed on our website are an invitation for bids. We are not obliged to accept your order. In the event that a product has the incorrect price given to a typographical error, we will notify you of the correct price and give you the option to purchase the product at the correct price or cancel your order with us. If payment has been charged for your purchase and you decide to cancel the order, we will give you a refund for money paid.

 

Payment:

At the moment we are only accepting payments through PayPal. We will not process any orders until we receive confirmation of payment. All transactions coded pass through this website using 128-bit SSL certificates. No credit card information if it is not encrypted. You can be absolutely sure that no information can be examined, used or modified to gain access to sensitive information.

 

Delivery:

We aim to have all orders out as quickly as possible. In the event that the goods are available, you can go to pick up your merchandise in the store previously assigned in 24 hours. In the event that the items purchased are not available, we will send an email to ask if you want to wait for (usually 2-3 weeks) or if you prefer, we will refund part or all the amount of the merchandise. When your goods have been dispatched, we will send you an email to let you know that your merchandise is ready to be picked up at the assigned store. (We currently only offer the option to pickup the goods purchased in the store previously assigned. Soon we will be providing delivery services.)

 

Risk and Title:

Transfer of ownership of the items ordered by you through our website, happens only when we receive payment for the full amount of the merchandise.

 

Right to cancel your order:

If you have submitted an order through our website and received a confirmation email from La Esquina Famosa, you can still cancel the order. Please reply to the e-mail you received and indicate “CANCEL MY ORDER” on the subject line. Subsequently you will receive confirmation of reimbursement through an email sent by us. Please be sure to provide your name and order number. In addition, you can view the history of purchases made by you on our site. Simply log into your account on the website and find the information there. If you want to make an exchange due to the item size, you may do so at the store you got the goods. If the size and/or item you want is available, the exchange is immediate. If the price is different than that of the item delivered, only pay the difference (the price being higher  than that of the item delivered). In the event you wish to return the purchased item, you may do so. In this case we will give you store credit for you to use at your convenience at any of our La Esquina Famosa stores. (We do not refund money, See Return Policy.)

 

Return Policy:

You can return the item in its original condition with the purchase receipt on hand within 10 days from the delivery date of the goods.

If you want to make an exchange due to item size, you may do so at the store where you picked up the goods. If the size and/or item you want is available, the exchange is immediate. If the price is different than that of the item delivered, only pay the difference. In the event you wish to return the purchased item, you may do so. In this case, it will give you store credit for you to use within 30 days at any of our La Esquina Famosa stores. We do not refund money.

 

Claims:

In the event we do not meet our high standards of customer service, do not hesitate to contact us via email: [email protected]. We will do everything in our power to assist you in your claim in order to reach a satisfactory solution.

 

Security:
We use PayPal as our payment service provider (PSP). Our priority is to ensure that the information is passed to the transaction is secure at all times. All transactions coded pass through this website using 128-bit SSL certificates. No credit card information if it is not encrypted. You can be absolutely sure that no information can be examined, used or modified to gain access to sensitive information.

We take privacy seriously. Our privacy policy governs the way we process the personal information you provide to us. If we decide to change the privacy policy of the website, we will post it here so you can know what kind of information we collect and how we may use that information. You can browse our site without revealing any personal information.

Personal information will only be collected with your consent. Your personal information (including your name, address and any other details you provide to us and that identifies you as an individual) will be processed by us for the following possible purposes.

Our liability is limited and does not exceed an amount equal to the value of the items purchased by you.
We are not liable for any claims received by you unless we receive the claim within 30 days or before they made their purchase.

Law and Jurisdiction:

These Terms and Conditions shall be governed according to the laws of the Commonwealth of Puerto Rico. Litigation relating to this website will be subject to the exclusive jurisdiction of the courts of Puerto Rico.

Agreement between the parties:

These Terms and Conditions represent the entire agreement and understanding between you and us in relation to any purchase of items within this website and/or any use of this website. Nothing in these Terms and Conditions affects the responsibility of both parties with respect to misinterpretation, warranties, or conditions that make fraudulent.

Force Majeure:

We will not be responsible for any delay, failure or breach of the Terms and Conditions from causes that are beyond our control, including any of the following situations: Government Decision, War, Fire, flood, explosion, failure in the telecommunications or technology failure of a third party (supplier, carrero etc.)

Disclaimer:

We have taken all proper steps to ensure efficiency and detail when providing information on this site. We make no warranties or representations as to the accuracy and detail of the content of the web page.
